DMCA Policy for Ongeval N279 Vandaag

Ongeval N279 Vandaag respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to notices of alleged copyright infringement that are reported to our designated Copyright Agent, identified below.

This policy describes the information that should be included in a copyright infringement notice and how to submit a counter-notification if your content has been removed by mistake.

Filing a DMCA Infringement Notice

If you are a copyright owner, or are authorized to act on behalf of one, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Ongeval N279 Vandaag website or service, please send a written notice to our Copyright Agent. Your notice must include substantially the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.

  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Filing a DMCA Counter-Notification

If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material, you may send a counter-notification containing the following information to our Copyright Agent:

  • Your physical or electronic signature.
  • Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content.
  • Your name, address, telephone number, and, if available, an email address.
  • A statement that you consent to the jurisdiction of the federal court in [Your Jurisdiction - e.g., the district court for the judicial district where your address is located, or if your address is outside of the United States, for any judicial district in which Ongeval N279 Vandaag may be found], and that you will accept service of process from the person who provided the original notification of the alleged infringement.

Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original DMCA infringement notice. If we do not receive notice from the original claimant that they have filed an action seeking a court order to restrain the user from engaging in infringing activity related to the material on our system within 10-14 business days, we may restore the removed material or cease disabling access to it.
